Cocrystal Technology (Jiaxing) Co. said a U.S. federal court invalidated two claims asserted by Kaneka Corp. in litigation involving the Kaneka ubiquinol patent and Cocrystal Tech’s CrysQnol ingredient. The company’s account of the ruling has not been independently verified.
In a company announcement dated Sept. 7, Cocrystal Tech said the U.S. District Court for the Eastern District of New York entered summary judgment in its favor on Sept. 2 and closed the case, Kaneka Corp. v. Cocrystal Technology (Jiaxing) Co. Ltd. et al., No. 1:23-cv-07483.
Ruling Would Affect Kaneka Ubiquinol Patent Claims
According to Cocrystal Tech, the court found the asserted claims of U.S. Patent No. 7,829,080 failed utility and enablement requirements. Kaneka had alleged that Cocrystal Tech’s Crystal QH product, subsequently renamed CrysQnol, infringed the patent after filing the lawsuit in October 2023, Cocrystal Tech said.
The company said the asserted claims concerned reduced coenzyme Q10 compositions containing reduced coenzyme Q11. It said the decision, if confirmed, would allow it to continue making and selling CrysQnol in the United States without restrictions arising from the invalidated claims.
Cocrystal Tech also said it is moving its ubiquinol product branding from Crystal QH to CrysQnol while maintaining the same formulation and specifications. Kaneka had not been represented in the supplied material, and the court docket and order should be reviewed to confirm the status and scope of the Kaneka ubiquinol patent decision.
